# Orthodontic Complaints UK

A poor treatment outcome, inadequate communication, or unexpected charges are all valid grounds for a formal complaint. This page covers who to complain to, what to expect from the process, and how to protect your position when treatment has gone wrong.

## When a complaint is warranted

A formal complaint is appropriate if your treatment outcome was significantly different from what was agreed, if the provider deviated from the agreed plan without explanation, if you experienced avoidable harm during treatment, if charges were applied that were not disclosed in advance, or if your requests for records, explanations, or refunds were unreasonably refused. Poor communication and inadequate follow-up are also grounds for complaint, even where the clinical outcome was acceptable.

## Step 1 — Raise it with the practice first

Most complaints should begin with the practice's own complaints procedure. This is typically the fastest route to resolution and is required before escalating to a regulatory body. Put your complaint in writing, describe the issue clearly, and request a written response. Practices are expected to respond to NHS complaints within ten working days and to acknowledge private complaints promptly. Keep copies of all correspondence.

## Step 2 — NHS complaints: contact NHSE or the ICB

If your orthodontic treatment was NHS-funded and the practice has not resolved your complaint satisfactorily, you can escalate to NHS England (NHSE) or your Integrated Care Board (ICB). The NHS complaints process can also be raised with the Parliamentary and Health Service Ombudsman if NHSE's response is unsatisfactory. NHS complaints must generally be made within 12 months of the event or of becoming aware of it.

## Step 2 — Private complaints: the Dental Complaints Service

For private treatment, the Dental Complaints Service (DCS) operated by the General Dental Council provides a free, independent complaints resolution service for patients who cannot resolve their complaint with the practice directly. The DCS can facilitate refunds, remedial treatment, or apologies, but cannot impose disciplinary sanctions on the clinician.

## Step 3 — GDC complaint: fitness to practise concerns

The General Dental Council (GDC) handles concerns about a registrant's fitness to practise — not dissatisfaction with a specific clinical outcome. The GDC is the right route if you believe the provider acted dishonestly, was impaired during treatment, caused patient harm through serious negligence, or continued treating patients after their registration lapsed. The GDC does not award compensation, resolve contractual disputes, or recover refunds.

## Civil route: small claims and legal action

Where your complaint involves financial loss — unpaid refunds, charges for remedial treatment elsewhere, or out-of-pocket costs resulting from negligent care — a small claims court claim (for amounts under £10,000) may be available. This requires evidence of the contract terms, the service failure, and the financial loss. For higher-value clinical negligence claims, specialist legal advice from a dental negligence solicitor is recommended.

## What records to gather before escalating

Useful records include your written treatment plan, the itemised quote and any payment receipts, before and after photographs, correspondence about concerns raised during treatment, details of any emergency appointments, and x-rays or digital scan files. Under UK data protection law, you are entitled to request copies of your dental records. The practice must provide them within one month. Records are essential for any escalated complaint or legal claim.

## How a second opinion helps your complaint

An independent clinical assessment from a second orthodontist can confirm whether the treatment outcome falls within acceptable clinical standards, whether a different approach would have been reasonable, and whether remedial treatment is likely to improve the result. A written second opinion from a GDC-registered specialist orthodontist carries significant weight in both Dental Complaints Service mediation and legal proceedings.

### Frequently Asked Questions

Can I get a refund for orthodontic treatment I am unhappy with?

It depends on the circumstances. If the provider delivered the treatment as agreed, a refund is unlikely unless there was a clear breach of contract or evidence of clinical negligence. If charges were applied that were not in the original quote, or if treatment was abandoned before completion without justification, you may have grounds for a partial refund. The Dental Complaints Service can facilitate refund discussions for private treatment.

How do I make a complaint to the GDC?

Complaints to the GDC are made through the GDC website. You will need to provide a written account of your concern, supporting evidence, and confirmation that you have already raised the issue with the practice. The GDC investigates concerns about fitness to practise — dishonesty, impairment, or serious clinical harm — not general dissatisfaction with outcomes.

What is the time limit for an orthodontic complaint?

NHS complaints should generally be made within 12 months of the treatment or of becoming aware of the problem. Private complaints to the Dental Complaints Service should be made within 12 months of the treatment ending. Civil claims for dental negligence are typically subject to a three-year limitation period from the date you became aware of the harm.

Can I complain about treatment that was done years ago?

For NHS complaints, the 12-month timeframe applies, although complaints outside this period may still be accepted if there is good reason for the delay. GDC fitness to practise complaints can be made at any time, but are more difficult to pursue without contemporaneous records. Civil legal claims are subject to the three-year limitation period from date of knowledge.

What happens if the practice ignores my complaint?

If the practice fails to respond to your written complaint within a reasonable time (10 working days for NHS, generally), you can escalate to NHS England or the ICB for NHS treatment, or the Dental Complaints Service for private treatment, without requiring a practice response.

Does a complaint affect my ongoing treatment?

A practice should continue providing your treatment regardless of a complaint being raised, unless there has been a complete breakdown in the clinical relationship. If the practice terminates treatment in response to a complaint being made, document this in writing and raise it as part of the complaint. Retaliatory treatment withdrawal is itself a matter for the GDC.
